A woman in her 30s has been handed a prison sentence after accusing her biological father, who had previously financed her education abroad, of rape because he refused her financial requests. This indicates a growing seriousness in handling such false accusations.
As reported by the legal community on the 1st, the Criminal Division 1 of the Namyangju Branch of the Uijeongbu District Court, presided over by Judge Choi Chi-bong, has recently determined that a woman, referred to as A, will serve a 10-month prison term. The charges include defamation, business obstruction, and insult.

Between May and June of the previous year, A was tried for making 11 defamatory posts on an online platform, with titles such as "I am a victim of familial sexual violence. Please look at this," targeting her father, B.
In these online posts, she falsely alleged, "I have been continuously sexually assaulted by my biological father since I was four years old, and my mother also suffered domestic and sexual violence," "The matter was settled with 30 million won in damages," and "Severe punishment is necessary."
Additionally, A revealed B's identity and business details, which reportedly caused him operational difficulties.
Moreover, A made six posts alleging that B had remarried a woman, C, claiming an affair led to this marriage.

In February 2021, A pursued a lawsuit against B for damages related to sexual assault in the Incheon District Court but was unable to substantiate her claims with evidence.
During the criminal proceedings, A maintained the truth of her statements; however, the court, referencing the lawsuit's results, dismissed her assertions, noting the absence of evidence or circumstances that suggested repeated sexual assault by B.
The court reasoned that A's allegations seemed unfounded, especially given that B had financially supported her overseas education and return, and that she made the rape accusations shortly after B declined her substantial financial request for a cafe business.

The court highlighted, "Her dissatisfaction stemming from denied financial support led her to disseminate false information about the victims. The reputational damage inflicted on the victims is irremediable."
Additionally, the court outlined their rationale for the sentence, stating, "Given the high probability of reoffending—as she persists in similar postings—and the victims' strong demand for harsh penalties, all these aspects were thoroughly considered."
